Firm Wins Another Ninth Circuit Appeal, 3-0

Lee Tran & Liang (“LTL”) continues its string of appellate victories. On April 12, 2010, the Ninth Circuit affirmed a decision in favor of LTL’s client. LTL attorney Daniel Taylor handled the briefing and oral argument in the Ninth Circuit.

Below, the Plaintiff had filed a complaint against LTL’s client, claiming LTL’s client had breached a settlement agreement. LTL brought a special motion to strike Plaintiff’s claims, which the Central District Court of California granted. Thereafter, the Court awarded LTL’s client $26,000 in attorneys’ fees and costs.

The Plaintiff then appealed the dismissal of its case to the Ninth Circuit. Judges Canby, Fletcher, and Tunheim unanimously affirmed, noting that Plaintiff had “not demonstrated a probability of success on the merits of its breach of contract claim . . . [and on] its equitable indemnity claim. . . . Because [Plaintiff’s] claims have underlying legal deficiencies that cannot be cured, amendment would be futile.”

LTL is seeking an additional $44,000 in attorneys’ fees and costs from the Plaintiff for the appeal.
